Specific Prohibitions
Remember, only qualified people with disabilities are protected from these types of discriminatory actions. There may be a few cases in which no person with a disability, or with a particular type of disability, will be qualified for a particular program, activity, or job. For example, a school-bus company may lawfully refuse to accept applications for driving jobs from people who are legally blind. In these cases, the employer's actions are not discriminatory, because no one who is legally blind will be qualified for a driving job. However, such cases are rare. Unless there is absolutely no possibility that any person with a disability, or with a particular disability, will be able to qualify for the program, activity, or job, it is unlawful to screen out all people with disabilities, or all people with a particular type of disability.
