Context of Aid, Benefits, and Services

In the context of provision of aid, benefits, and services, a "qualified individual with a disability" is a person with a disability who meets the eligibility requirements that are relevant to the receipt of the aid, benefits, or services provided in the program or activity.

In determining whether the person meets those requirements:

  • You must not consider architectural, communication, or transportation barriers to the person's participation.
  • You must consider any reasonable accommodation that can be made for the person's disability.
  • You must assume that auxiliary aids and services (communication aids) will be provided.
