Section 504 of the Rehabilitation Act of 1973

Employment Context

Image shows a help wanted ad.

In the employment context, a "qualified individual with a disability" is a person who:

  • meets the job-related requirements (such as skill, experience, or education) imposed by a particular employer for a particular job, and
  • is able to perform the essential functions of that specific job, with or without reasonable accommodations.

In deciding whether a person with a disability is qualified for a specific job:

  • You must not consider architectural, communication, or transportation barriers to the person's employment.
  • You must consider any reasonable accommodation that will enable the person to perform the essential functions of that specific job.
  • You must assume that auxiliary aids and services (communication aids) will be provided.
