Disability Defined
In order to provide protection from various types of discrimination, DOL's Section 504 regulations and other Federal disability nondiscrimination laws, use the following standard, three-part definition for the term "disability":
- A physical or mental impairment that substantially limits one or more of a person's major life activities;
- A record of such an impairment; or
- Being regarded [by a program, activity, training provider, employer, or other person or entity covered by the law] as having such an impairment.
So, an "individual with a disability," under DOL's Section 504 regulations, means someone who falls under one of these three categories. The next part of the training will examine each of these categories in detail.
