Section 504 of the Rehabilitation Act of 1973

Disability Defined

In order to provide protection from various types of discrimination, DOL's Section 504 regulations and other Federal disability nondiscrimination laws, use the following standard, three-part definition for the term "disability":

  • A physical or mental impairment that substantially limits one or more of a person's major life activities;
  • A record of such an impairment; or
  • Being regarded [by a program, activity, training provider, employer, or other person or entity covered by the law] as having such an impairment.

So, an "individual with a disability," under DOL's Section 504 regulations, means someone who falls under one of these three categories. The next part of the training will examine each of these categories in detail.
