Specific Activities in Which Discrimination is Prohibited

Discrimination is prohibited in the following activities relating to employment and employment-related training:

  • Recruitment advertising, and the processing of applicants for employment or employment-related training;
  • Hiring, upgrading, promotion, award of tenure, demotion, transfer, layoff, termination, right of return from layoff and rehiring;
  • Rates of pay or any other form of compensation and changes in compensation;
  • Assignments, classifications, organizational structures, position descriptions, lines of progression, and seniority lists;
  • Leaves of absence, sick leave, or any other leave;
  • Fringe benefits available by virtue of employment or participation in employment-related training, whether or not administered by the recipient;
  • Selection and financial support for employees for training, including apprenticeship, professional meetings, conferences, and other related activities, and selection for leaves of absence for employees to pursue training;
  • Employer-sponsored or training program-sponsored activities, including those that are social or recreational; and
  • Any other term, condition, or privilege of employment or employment-related training.
