Section 504 of the Rehabilitation Act of 1973

Pre-Offer Stage

In the pre-offer stage, if you are an employer, or a service provider screening applicants for employers or deciding whether to refer a particular applicant for a particular job or training course, the general rule is that you must not ask these types of disability-related questions:

  • questions to determine whether an applicant has a disability;
  • questions to determine the nature or severity of any disability the applicant might have.

(Exceptions to this general rule are discussed on the next page.)
